DayBox is operated by Max Voltage Store Pty Ltd (ABN 68 689 227 996) ("DayBox", "we", "us" and "our"). We operate this store and website, including all related information, content, features, tools, products and services (the "Services"), and we're powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use and disclose your personal information when you visit or use the Services, make a purchase, or otherwise communicate with us.

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and, where they apply to you, US state privacy laws. By using the Services, you acknowledge that you have read this policy and understand how your information is collected, used and disclosed.

1.Personal information we collect

"Personal information" means information that identifies you or can reasonably be linked to you. Depending on how you interact with the Services, we may collect:

  • Contact details — your name, billing and shipping address, phone number and email address.
  • Payment information — payment card details, transaction details and payment confirmation. Payments are processed securely by our payment providers; we don't store your full card details on our servers.
  • Account information — username, password, preferences and settings, if you create an account.
  • Transaction information — items you view, add to cart, purchase, return, exchange or cancel, and your order history (including preorders).
  • Communications — information you include when you contact our support team or leave a product review.
  • Device and usage information — your device, browser, IP address and how you interact with the Services, collected automatically including through cookies and similar technologies.

2.Where we collect it from

  • Directly from you — when you place an order, create an account, sign up to emails, or contact us.
  • Automatically — from your device when you use the Services, through cookies and similar technologies. You can manage these through the cookie preferences banner on our site.
  • From our service providers — when they collect or process personal information on our behalf.

3.How we use your personal information

  • Providing the Services — processing payments, fulfilling and shipping orders (including preorders), managing your account, handling returns, exchanges and warranty claims, and keeping you updated about your order.
  • Marketing and advertising — sending marketing emails (which you can unsubscribe from at any time) and showing you ads for our products on other websites and platforms, including based on items you've viewed or purchased.
  • Security and fraud prevention — authenticating accounts, providing a secure checkout, and detecting and preventing fraudulent or malicious activity.
  • Customer support — responding to your enquiries and providing effective service.
  • Legal reasons — complying with applicable law, responding to valid legal process, and enforcing our terms and policies.

4.How we disclose personal information

We disclose personal information to third parties for legitimate purposes, including:

  • Shopify, which hosts our store and processes information about your use of the Services. See the Shopify Consumer Privacy Policy or the Shopify Privacy Portal.
  • Service providers who perform services on our behalf — including payment processing, order fulfilment and shipping (from our Australian and US warehouses), email marketing (Klaviyo), analytics (Google Analytics), customer support (Gorgias) and product reviews (Judge.me).
  • Advertising and marketing partners (such as Meta and Google) to show you relevant ads. These partners use your information in accordance with their own privacy policies.
  • At your direction — for example, to a carrier to deliver your order.
  • Legal and business purposes — to comply with legal obligations, enforce our terms, protect the Services, or in connection with a business transaction such as a merger.

Depending on where you live, sharing information for targeted advertising may be considered a "sale", "share" or "targeted advertising" under certain US state privacy laws, and you may have the right to opt out. You can do so on our Your Privacy Choices page. If you browse with the Global Privacy Control signal enabled, we treat it as an opt-out request for that browser and device.

5.Third-party websites and links

The Services may link to websites operated by third parties, including maxvoltagestore.com. We're not responsible for the privacy or security of those sites — please review their policies. Information you share on social platforms may be viewable by other users of those platforms.

6.Children's data

The Services are not intended for children, and we don't knowingly collect personal information from children under the age of majority in their jurisdiction. If you're a parent or guardian of a child who has provided us with personal information, contact us using the details below to request that it be deleted. We do not have actual knowledge that we "share" or "sell" personal information of individuals under 16.

7.Security and retention

We take reasonable steps to protect your personal information, but no security measures are perfect and we can't guarantee "perfect security". Please don't send sensitive information through unsecured channels. We retain personal information for as long as needed to provide the Services, maintain your account, comply with legal obligations, resolve disputes and enforce our policies.

8.Your rights and choices

Depending on where you live, you may have some or all of the following rights. They aren't absolute and in certain cases we may decline a request as permitted by law:

  • Access / know — request access to the personal information we hold about you.
  • Correct — request that we correct inaccurate personal information.
  • Delete — request that we delete personal information we hold about you.
  • Portability — request a copy of your personal information, and in certain circumstances that we transfer it to a third party.
  • Opt out of targeted advertising — via our Your Privacy Choices page, depending on where you live.
  • Marketing preferences — unsubscribe from promotional emails at any time using the link in any email. We may still send non-promotional emails about your account or orders.

To exercise any of these rights, contact us using the details below. We won't discriminate against you for exercising them. We may need to verify your identity before processing a request, and you may authorise an agent to make a request on your behalf.

9.Complaints

If you have a complaint about how we handle your personal information, please contact us first and we'll respond within a reasonable period. If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, or, depending on where you live, your local privacy regulator.

10.International transfers

We may transfer, store and process your personal information outside the country you live in — including in Australia, the United States and other countries where our service providers operate. Where we do, we take reasonable steps to ensure your information is handled consistently with this policy and applicable law.

11.Changes to this policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for operational, legal or regulatory reasons. We'll post the revised policy here and update the "Last updated" date.
